Terms of Service
1. Acceptance of Terms
By accessing or using Alex AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Alex AI is a SaaS platform that enables real estate professionals to automate outbound calls to leads using AI voice technology. The Service includes AI call initiation, lead management, calendar booking, and reporting features.
3. Acceptable Use
You agree to use the Service only for lawful purposes. You must not use the Service to:
- Call numbers on the National Do Not Call Registry without written consent
- Violate the Telephone Consumer Protection Act (TCPA) or any applicable telemarketing laws
- Impersonate individuals or organisations
- Harass, threaten, or abuse any person
- Upload lead data you do not have lawful authority to contact
You are solely responsible for ensuring your use of the Service complies with all applicable laws, including TCPA and state telemarketing regulations.
4. TCPA Compliance
You represent and warrant that you have obtained all necessary consents required by the TCPA and applicable state laws before uploading any phone numbers to the platform. Alex AI provides opt-out handling (STOP reply) but you remain responsible for maintaining your own do-not-call list and ensuring prior express consent.
5. Subscription and Billing
Subscriptions are billed monthly in advance. Plans include a specified number of calls per month. Unused calls do not roll over. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
6. Free Trial
New accounts receive a free trial with 50 calls. No credit card is required during the trial. At the end of the trial period, you must subscribe to continue using the Service.
7. Data and Privacy
We collect and process data as described in our Privacy Policy. You retain ownership of all lead data you upload. We do not sell your lead data to third parties.
8. Intellectual Property
The Service, including all software, AI models, and infrastructure, is owned by Alex AI. You are granted a limited, non-exclusive, non-transferable licence to use the Service during your subscription term.
9. Limitation of Liability
To the maximum extent permitted by law, Alex AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including losses arising from TCPA violations or telemarketing compliance failures.
10. Termination
We reserve the right to suspend or terminate accounts that violate these Terms, particularly those that use the Service to make illegal calls or harass recipients.
11. Changes to Terms
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
